Final Notice & Public Explanation of a Proposed Activity in a 100-Year/500-Year Floodplain & Wetland

This is to give notice that HUD under 24 CFR Part 50 or Responsible Entity under 24 CFR Part 58 has conducted an evaluation as required by Executive Order(s) 11988, as amended by Executive Order 13690, and/or Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under  2024 Community Project Funding Program for grants B-22-CP-NJ-0612 & B-23-CP-NJ-1036. The proposed project is located at the following addresses in the City of Trenton, Mercer County:

and is located in the 100-Year floodplain/Federal Flood Risk Management Standard (FFRMS) floodplain and Riverine Wetland. The extent of the FFRMS floodplain was determined using was determined using the freeboard value approach. The project involves the expansion of the Assunpink Greenway trail to include park improvements to add amenities utilizing 2024 CPF Funding. Portions of the project are located both in the 100-Year floodplain/FFRMS floodplain and the riverine wetland. The project will potentially impact 0.07 acres of the 100-Year/FFRMS floodplain and 0.04 acres of the riverine wetland. All proposed project activities are expected to be outside the floodway.

 

The City of Trenton has considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain/wetland: The only alternative considered was changing project locations; however, that is not feasible as the project activities are specific to these sites. The No Action Alternative was also not considered as the sites would remain under-utilized. This project seeks to revitalize an impoverished area of the City with a history of environmental challenges into a greenway to restore the natural environment and provide recreational opportunities for residents and visitors alike. Implementation of the projects will be designed so that no mitigation techniques are necessary to avoid adverse impacts on the floodplain and to restore and preserve the natural or beneficial values of the floodplain. This project will comply with all state and local floodplain/wetland protection procedures

 

The City of Trenton has reevaluated alternatives to building in the floodplain/wetland and has determined that it has no practicable alternative to floodplain/wetland development. Environmental files documenting compliance with Executive Order 11988, as amended by Executive Order 13690, and/or Executive Order 11990, are available for public inspection, review, and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. 

 

There are three primary purposes for this notice. First, people who may be affected by activities in the 100-year floodplain/FFRMS floodplain/wetland riverine and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain/wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain/wetland, it must inform those who may be put at greater or continued risk.
